Tribunal Compensation Awards: Updated April 2026
Employment Tribunal compensation limits are reviewed annually and typically increase each April in line with statutory indexation.
For dismissals taking effect from 6 April 2026:
Maximum Compensatory Award
For ordinary unfair dismissal is £123,543, or 52 weeks’ gross pay, whichever is lower.
Maximum Statutory
Week’s pay has risen to £751, taking the maximum basic award to £22,530.
The Limit On A
Week’s pay used for statutory redundancy calculations has also increased in line with this figure.
A Significant Change is Coming in 2027
Employers need to be aware of a major shift ahead. From 1 January 2027, the Employment Rights Act 2025 will remove the statutory cap on compensatory awards for ordinary unfair dismissal entirely. This is a confirmed change, not a proposal; the government has already published the implementation timetable.
From that date, tribunals will no longer be bound by a fixed ceiling. Compensation will instead be based on the employee’s actual and projected financial loss, subject to the usual legal principles such as mitigation, contributory conduct, and Polkey reductions.
This is a far more significant change than the usual annual inflationary increase. Under the current cap, a higher-paid employee’s award can be limited even where their real losses are greater. Once the cap is removed, senior employees with substantial salaries, bonuses, or other remuneration could bring considerably larger claims.
That said, this doesn’t mean every successful claim will suddenly be unlimited. Tribunals will still assess actual loss and the claimant’s duty to mitigate it; the government’s own figures show the median unfair dismissal award in 2023/24 was just £6,746, with relatively few cases reaching the current upper limits.
The qualifying period for bringing an unfair dismissal claim is also reducing, from two years’ service to six months, with effect from the same date.
What this means for employers: there is a window now, before the uncapped regime arrives, to strengthen disciplinary, performance management, grievance, and dismissal procedures. Robust, well-documented processes reduce risk regardless of the compensation cap; from 2027, they matter more than ever.
Discrimination Claims Remain Uncapped
Discrimination compensation has never been subject to an overall statutory cap. In addition to financial losses, successful claimants may receive compensation for injury to feelings under the Vento guidelines.
From 6 April 2026, the updated Vento bands are:
